Fundamental Rights","content":"Fundamental rights are an essential part of the Constitution of India. They protect the liberty, equality and dignity of every citizen and ensure that all persons are treated fairly before the law. These rights include equality before law, freedom of speech and expression, protection of life and personal liberty, and freedom of religion. The Constitution also provides remedies when any fundamental right is violated. Courts have an important responsibility to protect these rights and prevent unlawful action by public authorities. Fundamental rights strengthen democracy and help citizens live with freedom, security and dignity. However, these rights are subject to reasonable restrictions imposed by law in the interest of public order, security and the welfare of society. The protection of fundamental rights is necessary for creating a just and democratic society. Citizens may approach the courts when their constitutional rights are affected, and the judiciary can provide suitable relief according to the law. These rights also ensure that the powers of the government are exercised within constitutional limits and that every individual receives equal protection of the law. The Constitution of India groups the fundamental rights under separate heads. The right to equality forbids discrimination by the State and guarantees equal opportunity in matters of public employment. The right to freedom includes freedom of speech and expression, the freedom to assemble peacefully, to form associations, to move freely throughout the territory of India and to practise any lawful profession or trade. These freedoms are not absolute, and the State may impose reasonable restrictions on them in the interest of public order, decency, morality and the security of the nation. The right against exploitation prohibits forced labour and the employment of young children in hazardous work. Cultural and educational rights protect the interests of minorities in preserving their language, script and culture. The most important safeguard, however, is the right to constitutional remedies, which allows a person to move the court directly when any of these rights is violated. The court may then issue directions, orders or writs to restore the right. It is often said that this provision is the heart of the Constitution, because a right without a remedy would have little value. Citizens should also remember that rights and duties go together, and that respect for the rights of others is the foundation of a free society.","testTypes":["rajasthan-high-court"],"createdAt":"2026-08-24T16:33:25.849Z","updatedAt":"2026-10-18T19:59:11.142Z","__v":0},{"_id":"6a8c709ef1cc86a18941d35b","title":"2. Indian Constitution","content":"The Constitution of India is the supreme law of the country and provides the basic framework for its democratic system. It defines the powers of the Legislature, the Executive and the Judiciary and protects the rights and freedoms of citizens. The Constitution guarantees equality before the law and provides important safeguards against arbitrary action. An independent judiciary plays an essential role in protecting constitutional rights and maintaining the rule of law. Every citizen has a duty to respect the Constitution and follow the laws of the country. The principles of justice, liberty, equality and fraternity are important features of Indian democracy. The Constitution also provides a system of checks and balances among different organs of the State. It ensures that public authorities exercise their powers according to law and remain accountable to the people. The strength of a democracy depends upon the proper functioning of its institutions and the respect shown by citizens towards constitutional values. A fair and independent legal system helps to protect individual rights and promotes confidence in the administration of justice. The Constitution of India came into force after long and careful deliberation by the Constituent Assembly, and it is one of the most detailed constitutions in the world. It establishes a parliamentary form of government in which the executive is responsible to the elected legislature. It also creates a federal structure, dividing powers between the Union and the States through separate lists of subjects, while keeping a strong centre for matters of national importance. The Constitution provides for an independent judiciary with the power of judicial review, so that laws and executive actions which violate its provisions can be declared invalid. The Directive Principles of State Policy guide the government in framing laws for social and economic welfare, even though they cannot be enforced in a court. The Fundamental Duties remind every citizen of the obligation to respect the national flag, protect public property, safeguard the environment and promote harmony among all people. The Constitution is not a rigid document. It can be amended through a prescribed procedure to meet the changing needs of society, but its basic structure cannot be destroyed. In this way the Constitution combines stability with flexibility and continues to guide the working of every public institution in the country.","testTypes":["rajasthan-high-court"],"createdAt":"2026-08-24T16:26:06.762Z","updatedAt":"2026-10-18T19:59:13.001Z","__v":0}]
